1. Acceptance of terms

Sinergate Funds is a division of Sinergate Management LLC, a company registered in Wyoming, United States (“Sinergate Funds”, “we”, “us”, or “our”). By accessing this website or entering into a recovery agreement with us, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site or our services.

2. The service

We help property owners and other eligible parties identify and recover surplus funds (also called excess proceeds) that remain after a tax-lien or foreclosure sale. Our role is to locate potential funds, verify entitlement, prepare and file the required paperwork, and communicate with the relevant county, court, or agency on your behalf.

Sinergate Funds is not a law firm and does not provide legal, tax, or financial advice. We act as a recovery agent under a written agreement that you review and sign. Where a matter requires legal representation, we may recommend that you consult an attorney.

3. Our agreement and authorization

Before we begin recovering funds on your behalf, you sign a recovery agreement and, where required, an IRS Form W-9 and a limited authorization allowing us to act for you with the holding authority. These documents set out the specific claim, our fee, and the scope of what we are authorized to do.

4. Fees

• We work on a contingency basis: our fee is a percentage of the amount actually recovered.
• You pay nothing up front. If we recover no funds, you owe us no fee.
• The exact percentage is disclosed and agreed in writing in your recovery agreement before any work begins.
• Any third-party costs, where applicable, are disclosed to you in advance.

5. Your responsibilities

• Provide accurate, complete information and documentation when requested.
• Sign the required forms so we can act on your behalf.
• Not engage another recovery company to pursue the same claim at the same time.
• Notify us promptly if a county, court, or third party contacts you about the claim.

6. No guarantee of outcome

Eligibility, the amount available, and the time required to recover surplus funds are determined by the relevant county, court, or agency and by applicable law. We cannot and do not guarantee that any specific amount will be recovered, or that a claim will be resolved within a particular timeframe.

7. Acceptable use

You agree not to:

• Use the website or our services for any unlawful or fraudulent purpose.
• Provide false, misleading, or fraudulent information or documents.
• Attempt to gain unauthorized access to our systems or client accounts.
• Copy or redistribute our content for commercial purposes without permission.

8. Intellectual property

The Sinergate Funds and Sinergate names, logos, and website design are the property of Sinergate Management LLC. You may not use them without our prior written permission.

9. Disclaimer of warranties

The website and our services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, Sinergate Management LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the website or our services. Our total liability in connection with a claim shall not exceed the fees you have actually paid to us for that claim.

11. Termination

Either party may end the engagement in accordance with the terms of your signed recovery agreement. We may decline or discontinue a claim if we are unable to verify entitlement or if continuing would be unlawful.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles.
